Penalties for sex crimes can vary depending on the specific charge, felony classification and details of the case, but will usually adhere to the guidelines set in ARS 13-1406 as a class 2 felony. In addition to any fines and lifetime registration as a sex offender, those convicted of sexual assault or rape are often sentenced to time in jail as well.

 

  • First-Time Offenders can serve between 5.25 and 14 years in jail.
  • Those with a single prior felony may have to serve 7-21 years in jail.
  • If the accused has 2 or more felonies, jail time is further extended with a minimum of 14 years to 28 years behind bars.
  • If the victim was unknowingly drugged an additional 3 years is added to any sentence.

 

If charged with a violent sexual assault, which involves the use or threatening exhibition of a weapon, and found guilty, the accused will be sentenced to life imprisonment without the possibility of parole.
